Safety and Fitness Electronic Record (Company and Driver Snapshot and Safety Rating)

The rule, required under the Hazardous Materials (HazMat) Transportation Authorization Act and the Transportation Equity Act for the 21st Century (TEA-21), is effective April 29, 2004. It applies to all motor carrier employers regulated by the Federal Motor Carrier Safety Regulations (FMCSRs).

Applying the FLSA's definition, workers who are economically dependent on the business of the employer, regardless of skill level, are considered to be employees, and most workers are employees. On the other hand, independent contractors are workers with economic independence who are in business for themselves.
